Mattress Forever Warranty

Mattress Forever Warranty™

I. Policy: Forever Warranty™ Limited Mattress Warranty

Effective Date: June 5, 2026

If your purchase was made before the effective date, please contact the CastleUp Experience Centre or the applicable manufacturer’s customer support team to review the warranty terms that applied when your mattress was purchased.

Applicable Products

This Limited Warranty applies to eligible new Nectar and DreamCloud mattresses purchased directly from Nectar, DreamCloud or an authorized retailer, including the CastleUp Experience Centre, subject to all terms and conditions below.

II. Warranty Coverage

Eligible Nectar and DreamCloud mattresses are also covered by a home trial period that may allow customers to return the mattress if they are not satisfied.

The home trial and Forever Warranty™ are separate programs. Each program has its own eligibility requirements, exclusions and claim procedures.

III. Who Is Covered

This Limited Warranty is valid only for the original purchaser, beginning on the original delivery date of the mattress. It is non-transferable.

For the purposes of this Limited Warranty, the “original purchaser” is the first person who purchases a new Nectar or DreamCloud mattress directly from Nectar, DreamCloud or an authorized retailer, including the CastleUp Experience Centre.

Customers must retain their original sales receipt or invoice as proof of purchase and ownership.

If the original purchaser sells, gives away or otherwise transfers ownership of the mattress to another person, this Limited Warranty will terminate. The subsequent owner accepts the mattress “as is” and “with all faults.”

IV. What Is Warranted

This Limited Warranty applies to eligible Nectar and DreamCloud mattresses purchased new and in their original packaging directly from the manufacturer or an authorized retailer.

The mattress is warranted against qualifying defects in materials and workmanship, as described below, beginning on its original delivery date.

A replacement mattress remains subject to the warranty term of the original mattress. Receiving a replacement mattress does not restart or extend the original warranty period.

Mattresses included in a bundle are covered by this mattress warranty. Furniture, bedding, adjustable bases, bed frames and other non-mattress products included in a bundle are covered by their applicable separate warranties.

Geographic eligibility, replacement delivery and transportation services may be subject to the manufacturer’s service area and current warranty terms.

V. Covered Defects

Subject to inspection and approval, this Limited Warranty may cover the following manufacturing defects:

Visible Indentations

Deterioration that causes the mattress to develop a visible indentation greater than one and one-half inches (1.5"), provided that the indentation is not caused by the use of an improper, damaged or unsupportive bed frame, foundation or base.

The mattress must be continuously supported by a suitable foundation, platform bed or adjustable base with a proper frame capable of supporting the combined weight of the mattress and its user or users.

Foam Damage

A physical defect that causes the mattress foam to split, crack or materially degrade despite normal use and proper handling.

Mattress-Cover Defects

A manufacturing defect in the materials or assembly of the original mattress cover.

VI. What This Limited Warranty Does Not Cover

This Limited Warranty does not cover:

  • A mattress from which the original cover has been removed, unless the manufacturer has specifically stated that the cover is removable
  • Damage caused by environmental conditions, moisture, mould, excessive humidity or improper storage
  • Damage resulting from misuse, neglect, accident or failure to follow the manufacturer’s instructions
  • Damage caused by using an improper, damaged or unsupportive frame, foundation, box spring or bed base
  • A normal increase in the softness of the foam that does not affect the mattress’s pressure-relieving or supportive qualities
  • Personal comfort or firmness preferences
  • Burns, cuts, tears, punctures, liquid damage, stains, odours or other physical abuse
  • Normal wear and tear
  • Mattresses sold as-is, used, returned, previously owned, preconditioned, reconditioned, floor-model or open-box, unless otherwise stated in writing or required by applicable law
  • Damage caused during transportation or moving after the original delivery
  • Replacement delivery or transportation outside the manufacturer’s applicable service area
  • Mattresses used for commercial, institutional or rental purposes unless expressly approved by the manufacturer

VII. Warranty Remedy

When an eligible defect is confirmed, the manufacturer’s sole liability and the customer’s sole remedy under this Limited Warranty will be as follows:

During the First 10 Years of Ownership

The manufacturer may replace the defective mattress with a new Nectar or DreamCloud mattress of equal or greater value, subject to product availability and the applicable warranty-claim process.

Approved replacement mattresses may be provided without a mattress replacement charge. Delivery, transportation, inspection or removal charges may apply depending on the customer’s location and the manufacturer’s current policy.

After the First 10 Years of Ownership

At the manufacturer’s discretion, the manufacturer may:

  • Repair and re-cover the mattress; or
  • Replace the mattress through the applicable warranty-claim process.

Transportation fees may apply in each direction. These fees may be waived if the manufacturer confirms that the mattress contains an eligible defect in materials or workmanship.

Replacement models, colours, materials and specifications may differ from the original mattress when the original model is no longer available.

VIII. Customer Responsibilities

For this Limited Warranty to remain valid:

  • The mattress must be used on a firm, solid and structurally suitable foundation, platform, adjustable base or bed frame
  • The support system must be capable of supporting the combined weight of the mattress and its user or users
  • The mattress must be used and maintained in accordance with the manufacturer’s instructions
  • The original mattress cover must remain attached unless it is specifically designed to be removable
  • The customer must provide proof of original purchase
  • The customer may be required to provide photographs, videos, measurements or other evidence of the defect
  • The customer must cooperate with any inspection, return, donation, disposal or transportation process
  • The mattress must be sanitary and free from stains, liquids, mould, infestation, burns, tears and other damage unrelated to the alleged manufacturing defect

The manufacturer may authorize photographic or video evidence instead of requiring the mattress to be physically returned.

IX. How to Make a Warranty Claim

Customers who purchased an eligible Nectar or DreamCloud mattress online or in-store from the CastleUp Experience Centre should contact CastleUp Customer Support with:

  • The original order number or invoice
  • The purchaser’s full name
  • The mattress model and size
  • The delivery date
  • A description of the suspected defect
  • Clear photographs or videos showing the issue
  • Photographs of the mattress foundation, frame or adjustable base
  • Any measurements requested by the manufacturer

Submitting a claim does not guarantee approval. All claims are subject to inspection, verification and the applicable manufacturer’s warranty terms.

X. Warranty Limitations and Disclaimers

Any implied warranties, including warranties of merchantability or fitness for a particular purpose, are limited to the duration permitted under applicable law.

Some provinces, territories or states do not permit limitations on the duration of implied warranties. As a result, certain limitations may not apply to every customer.

No representative of Nectar, DreamCloud, CastleUp or any distributor or authorized retailer is permitted to alter or expand this Limited Warranty unless the change is provided in writing by the applicable manufacturer.

Retailers may offer additional or extended protection plans, including fabric, accidental-damage or product-protection plans. These plans are separate from the manufacturer’s Limited Warranty. Nectar and DreamCloud are not responsible for warranties or protection plans independently offered by a retailer or third-party provider.

The remedies stated in this Limited Warranty are the customer’s sole and exclusive remedies for an eligible manufacturing defect.

To the extent permitted by applicable law, Nectar and DreamCloud will not be responsible for indirect, incidental, consequential, special, punitive or exemplary damages arising from the use, repair, replacement or condition of the mattress.

The manufacturer’s total responsibility will not exceed the original purchase price of the mattress or the value of the approved repair or replacement.

Using an inappropriate, damaged or unsupportive foundation, box spring, platform or bed frame may void this Limited Warranty.

Nectar and DreamCloud reserve the right to discontinue products and change product materials, construction, dimensions or specifications without notice. When an original product is discontinued, a reasonably comparable product may be used as a replacement.

Nectar and DreamCloud do not warrant that any mattress is appropriate for a particular medical condition. Customers with medical concerns should consult a qualified healthcare professional.

No warranty applies beyond the coverage expressly described in this Limited Warranty.

XI. Dispute Resolution, Jury Waiver and Class-Action Waiver

Where permitted by applicable law, disputes may be subject to the manufacturer’s applicable dispute-resolution process.

The customer may be agreeing to resolve disputes on an individual basis and may be waiving participation in a jury trial, class action or representative proceeding.

Any dispute-resolution, arbitration or waiver provision will apply only to the extent that it is valid and enforceable under the laws applicable to the customer’s purchase and location.

Customers should review the applicable manufacturer’s dispute-resolution terms before purchasing.

XII. Provincial, Territorial and State Rights

This Limited Warranty gives customers specific legal rights. Customers may also have additional rights under applicable federal, provincial, territorial or state consumer-protection laws.

Nothing in this Limited Warranty is intended to exclude, restrict or replace any right or remedy that cannot legally be excluded or restricted.
